Many people aren’t aware that a signi cant ra of changes will soon be upon us a ecting Lasting Powers of Attorney (“LPAs”). e new law has achieved cross-party support from politicians, so the changes forecast for the end of 2024 should be coming whoever might next be in power. e general aim of the new law will be to modernise our current system of registering LPAs. It has four major goals: 1. Allowing LPAs to be prepared more online than before; 2. Safeguarding better against potential fraud and abuse; 3. Limiting who can actually register LPAs; 4. Allowing more people chance to object to registering LPAs. By making the registration process more computerised, the government believes it will become faster, more user friendly and more streamlined when it comes to identity checking those involved to prevent fraud. We are told that the veri cation checks made using the future online system will be “robust”. As for the latter two goals, these will make for interesting changes to the law. Previously LPAs could be registered by either the “donors” (the people giving the powers to others) or their attorneys. Soon, only the donors will be allowed to register new LPAs. is may create problems for people who have made LPAs in the past, but who have sat on the paperwork and then lost their capacity. As for challenging the registration of LPAs, widening the pool of people who can challenge seems on the face of it to be a positive change. If there are genuine concerns about a vulnerable person appointing someone, then it is morally right to challenge an LPA. However, for families with long-running disputes, spiteful challenges may well slow down otherwise normal applications. Practitioners seem to think these changes will be a mixed bag.
